1. Acceptance of Terms

By accessing or using carvinatx.com (the “Website”), operated by CARVIN ATX LLC, a Texas limited liability company doing business as “CarVin ATX” (hereinafter “Company,” “we,” “us,” or “our”), you (“User,” “Visitor,” or “you”) agree to be bound by these Terms of Use (“Terms”). If you do not agree, you must not access or use this Website.

2. Intellectual Property Rights — Comprehensive Protection

2.1 Ownership

All content, materials, and elements appearing on this Website — including but not limited to text, graphics, logos, icons, images, photographs, videos, audio clips, page layouts, visual designs, color schemes, typography, user interface designs, software, source code, HTML, CSS, JavaScript, PHP, database structures, compilations of data, the selection and arrangement thereof, and the overall “look and feel” of the Website — are the exclusive property of CARVIN ATX LLC or its licensors, and are protected by U.S. and international copyright, trademark, trade dress, patent, and other intellectual property laws.

2.2 Original Design

The Website features original design elements created exclusively for CarVin ATX, including but not limited to: (a) the Federal Registration Trust Bar identifying our SAM.gov registration; (b) the multi-step Sell Your Car valuation interface; (c) the integrated VIN decoder presentation; (d) the Navy-and-Gold visual identity system; and (e) the modular page architecture. These elements constitute original creative works owned by CARVIN ATX LLC.

2.3 Prohibited Acts

Without prior express written consent from an authorized officer of CARVIN ATX LLC, you may NOT:

• Copy, reproduce, duplicate, mirror, frame, or republish any portion of the Website;
• Imitate, replicate, or create derivative works based on the visual design, layout, or “look and feel” of the Website;
• Scrape, harvest, extract, or systematically download any content, inventory data, or vehicle listings;
• Reverse-engineer, decompile, or attempt to extract the source code;
• Use any automated system (bots, crawlers, spiders, scrapers) to access the Website except for legitimate search engine indexing;
• Use any content for commercial purposes, including training artificial intelligence or machine learning models;
• Remove, alter, or obscure any copyright, trademark, or proprietary notice;
• Sell, license, sublicense, rent, lease, or transfer any portion of the Website or its content.

2.4 Trademarks

“CarVin ATX,” “CARVIN ATX,” the CarVin ATX logo, and any associated taglines are trademarks or service marks of CARVIN ATX LLC. All other trademarks displayed on the Website (e.g., vehicle manufacturer names, Carfax, NHTSA) are the property of their respective owners and are used for identification purposes only.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and view the Website for personal, non-commercial purposes only in connection with browsing our vehicle inventory, submitting inquiries, or contacting our dealership. Any other use requires prior written consent.

4. Website Content & Vehicle Listings

4.1 Accuracy

While we strive for accuracy, all vehicle listings, pricing, photographs, descriptions, mileage figures, and availability are provided “AS IS” and are subject to change without notice. Pre-owned vehicles are sold in their current condition. We make no warranties or representations regarding the completeness or accuracy of any listing.

4.2 Pricing

Advertised prices exclude tax, title, license, dealer documentary fees, finance charges, and any other applicable government fees. Prices are subject to change. In the event of a typographical or pricing error, CarVin ATX reserves the right to correct the error and is not bound by erroneous listings.

4.3 Photographs

Vehicle photographs may be stock images or representative photos. Actual vehicles may differ. We recommend physical inspection prior to purchase.

5. User Submissions

5.1 Forms & Information

When you submit information through our forms (Sell Your Car, Credit Application, Financing, Contact, etc.), you represent that all information provided is true, accurate, and your own. You authorize CARVIN ATX LLC to: (a) verify the information; (b) contact you regarding your inquiry; (c) share information with relevant third parties (lenders, NHTSA, vehicle history providers) solely to process your request.

5.2 No Confidentiality

Information you voluntarily submit through public-facing forms (excluding sensitive financial data covered under our Privacy Policy) is not considered confidential. Suggestions or feedback you submit may be used by us without compensation.

5.3 SMS / Text Messaging Program Terms (TCPA)

CarVin ATX offers two text messaging programs: (a) marketing messages — offers, news, inventory updates, and dealership announcements; and (b) transactional messages — appointment confirmations, service updates, and responses to your inquiries. You enroll only by checking the corresponding optional consent box on one of our website forms, or by initiating a text conversation with us. Checking a consent box is never required to submit a form or to make a purchase. Consent is not a condition of purchase.

• Message frequency varies. Message and data rates may apply.
• Opt-out: reply STOP to any message at any time to cancel. After you send STOP, we will send one final message confirming your unsubscription; no further messages will be sent unless you re-subscribe.

• Wireless carriers are not liable for delayed or undelivered messages.
• Mobile phone numbers, text messaging originator opt-in data, and consent records are used solely by CarVin ATX and are never shared, sold, or provided to third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for full details on how we handle your information.

The Website may integrate or link to third-party services (Google Maps, NHTSA VIN decoder, lender pre-qualification tools, payment processors, Carfax, etc.). We do not control, endorse, or assume responsibility for any third-party content or services. Your use of third-party services is governed by their respective terms.

Vehicle sales are governed by separate written purchase agreements signed at the dealership. Information on this Website does not constitute an offer, warranty, or contract.

You agree to indemnify, defend, and hold harmless CARVIN ATX LLC and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from: (a) your violation of these Terms; (b) your misuse of the Website; (c) your violation of any third-party rights; or (d) any content you submit.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. Any dispute arising out of or related to these Terms or the Website shall be resolved exclusively in the state or federal courts located in Travis County, Texas, and you consent to personal jurisdiction therein.

11. Modifications

We reserve the right to modify these Terms at any time. Changes are effective upon posting to the Website. Your continued use after changes constitutes acceptance. We encourage you to review periodically.

12. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
